Terms and conditions

These terms govern your reservation and stay at The Columbus Hotel, operated by 52 Cottage Street LLC (the Hotel, we, us) at 52 and 89 Cottage Street, Middletown, New York. By booking or staying with us, you agree to them. Please read them alongside our Cancellation and Refund Policy and our Privacy Policy.

Who can book

  • The person holding the reservation must be at least 21 years old and must be one of the guests staying. We may ask for a government-issued photo ID that matches the reservation at or before check-in.
  • You are responsible for everyone in your party and for their compliance with these terms and our house rules.

Reservations, rates, and payment

  • Rates are quoted per suite, per night, in US dollars, and confirmed when you book. Applicable taxes and a cleaning fee are added and shown before you pay.
  • Payment is due as stated on your rate plan at the time of booking. Direct bookings are processed through our booking system; card details are handled by our payment processor and are never stored by the Hotel.
  • We may place a refundable pre-authorization or hold on your payment method for incidentals and damage. Any hold is released after checkout, less any amounts properly charged under these terms.

Check-in, access, and required registration

  • Check-in is from 4:00 PM and checkout is by the time shown on your reservation confirmation. Early check-in or late checkout may be available on request and must be approved in writing before arrival.
  • Access is by smart lock: one code for the building entrance and one for your suite. Before we can release your access codes, you must complete and sign the guest registration we send for every stay. Codes are released only after registration is complete.
  • Failure to complete this required registration is not a Hotel fault and is not grounds for a refund. Reach us any time during your stay and we will help you get in.

Occupancy and registered guests only

  • Only the guests named on the reservation may stay or be on the property, and the maximum occupancy shown for your suite may not be exceeded.
  • No unregistered visitors, parties, events, gatherings, or commercial photography or filming.

House rules

Our house rules are part of these terms and are enforced. In summary: no smoking, vaping, or cannabis anywhere inside the suites, buildings, hallways, or common areas; no pets; quiet hours from 8:00 PM to 8:00 AM; one standard-size vehicle per reservation in first-come, first-served parking; and no rearranging or removing furniture.

Smoking, vaping, or cannabis use inside triggers a minimum $500 charge plus the cost of smoke remediation and any lost nights. The full house rules are published on our Good to Know page.

Damage and responsibility

  • You are responsible for the suite and its contents during your stay and for any loss or damage beyond normal wear, whether caused by you or anyone in your party. We may charge your payment method for repair, replacement, additional cleaning, and lost revenue.
  • Report any damage or maintenance issue promptly through your reservation messages so we can respond.

Our right to refuse or end a stay

We may decline, cancel, or end a stay, and remove guests, without refund, for a violation of these terms or our house rules, misrepresentation on the reservation, exceeding occupancy, unsafe or disruptive conduct, or any unlawful use of the property.

Extended stays of 30 nights or more

Stays of 30 nights or more may be offered under a separate occupancy or lease agreement and may be subject to New York tenancy provisions rather than these transient-stay terms. Where a separate agreement applies, that agreement governs. Ask us about extended terms before booking.

Limitation of liability and assumption of risk

  • The buildings are historic walk-ups with stairs and no elevator. You accept the property as-is and assume the ordinary risks of a self-access stay.
  • To the fullest extent permitted by law, the Hotel is not liable for indirect, incidental, or consequential damages, or for loss of or damage to personal property, and our total liability for any claim will not exceed the amount you paid for the stay giving rise to the claim. Nothing here limits any liability that cannot be limited under New York law.

Indemnification

You agree to indemnify and hold harmless the Hotel and its operator, staff, and agents from claims arising out of your stay, your guests, or your breach of these terms, except to the extent caused by our own negligence.

Force majeure

We are not responsible for a failure to perform caused by events beyond our reasonable control, including utility failures, severe weather, government action, or emergencies. In those cases we will work with you in good faith on rebooking or a refund under our Cancellation and Refund Policy.

Bookings made through other platforms

Reservations made through Airbnb, Expedia, Booking.com, or another channel are also subject to that platform's terms and to the cancellation policy shown at the time of booking. Where a platform's cancellation terms differ from ours, that platform's terms apply to that reservation.

Changes and governing law

  • We may update these terms; the version in effect when you book applies to your stay.
  • These terms are governed by the laws of the State of New York, and any dispute will be handled in the state or federal courts located in Orange County, New York.
